By that rational, how do we have photographs of any other statue, artwork, or other public displays on this website? I am not claiming copyright of the marker itself, only the photograph of the marker. If depends where the statue is and when it was erected. A lot of countries (mine included) let you take pictures of anything in a "public place" without any problems - it's called Freedom of panorama. Sadly the USA decided not to do that, it only applies to buildings, not sculptures/monuments/memorials. If erected pre-1978 (when US copyright laws starting changing) then it's probably OK, otherwise the creator of the sculpture has the copyright, and to show here, one has to get permission from him/her. Wow, I didn't even know about that... that's just bullshit (not directed at you, but my own government)... My only concern is the number of images of historical markers, etc. that are up here on Wikipedia, and the loss of such documentation... It doesn't seem to well publicised. To us it looks like the land of the free is the land of the lawyers... I do agree with you. Since the person died in 1931 obviously this photo might have been published in India before 1951. I have replaced the old tag of licencing with new ((PD-India)) on its file description page to which please see.
