Orphaned. This photo, while uploaded in good faith, is a derivative work of the toy it depicts and thus would require permission from whoever made the toy. The body proportions don't look right at all, but I think the face looks like the "my precious" guy from Lord of the Rings? So I'm assuming that the uploader is not the copyright holder of the toy. I do not believe these toys are copyright protected. They themselves are not marked, nor was the packaging that they came in. Historically, poses of toy figures such as these were shamelessly copied by other companies, and I don't believe this would have been possible if they had been copyright protected. They are not of unknown source. As clearly captioned, they are produced by A Call to Arms, Accurate, and Italeri. They are as I described them, without copyright notice. Would you like me to contact the companies, if they are still in business, and ask if they are copyrighted, and/or ask for permission for the picture? Honestly, I do not understand the zealous and overly restrictive copyright interpretations on Wikipedia (one of several reasons I stopped contributing a few years ago). In fact, I would argue that even if these figures are copyrighted, this usage falls under fair use for noncommercial, educational purposes. Year of publication? I believe toys are manufactured, not published. But more to the point, why do you and Mr. Deadstar assume there is a copyright violation in the absence of any complaint or evidence? Is this guilty unless proven innocent? Wikipedia's policy on this appears to be vague, arbitrary, and unnecessarily restrictive.
