• Delete as non-free. Generally, free-to-download is not sufficiently free to qualify as free content under Wikipedia's copyright policy (WP:COPYRIGHT), see WP:COPYOTHERS. I could not determine from the website what the exact license is for the modification, but I don't think the mod is licensed permissively to allow for the creation and free licensing of derivative works (such as screenshots). Additionally, the fact that this is a mod calls into question whether making and distributing a screenshot of the modded game creates a derivative work of the original game, which is definitely not free. • The point is, I'm the creator of the shown content. I own the copyright for what I have created. That includes the mod's logos and any type of in-game assets that have NOT been created by Ensemble Studios or Big Huge Games, the makers of AoE3. Practically most mods would go with a GFD License since all modders want to be asked for permission. That may neither be a written rule nor a law, but it's a widely accepted and used standard. All this copyright nitpicking on wikipedia annoys me, I'd like to make it as comfortable as possible. I'm the creator of these files, but I allow their usage on wikipedia. Finito!   • You do not own the copyright of custom content from Age of Empires III, Microsoft does. Or Ensemble Studios, or whatever, but not you. Check the "About" section at the begining of the game. The general policy for game studios is not to enforce their copyright, and allow people to exchange screenshots, gameplay recordings, scenarios, campaigns, mods, etc, as if the game was de-facto freely licenced; but that's just a marketing strategy.       • A mod is not a new software that the authors may copyright as desired, but a derivative work of another software, which in this case is protected. See here: "Unless otherwise specified, the Services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services."         • I think there is a distinction between the content in the mod (such as sprites, models, textures, and so on) and the software code (if any) in the mod. One could make the case that if Microsoft/Ensemble has knowledge of the mod and does nothing to enjoin its distribution, it has given an implied license to make and distribute the mod. Because this would make the incorporation of AoE3 content in the mod lawful, this would allow the mod and its content to have a separate and distinct copyright as a derivative work, which then, presumably, could be freely licensed 17 U.S.C. §103(a). However, even if this is the case, there is no indication that the mod is freely licensed, so this image is definitely not free as it stands right now.           • That's exactly what I'm telling. That's the principle of mods. They modify original content significantly so that the result is the intellectual property of the modder. He holds the copyright for the modifications he made. It's not a copy. Mind that modifying includes such things as extending, combining, varying, reducing. These actions are considered to be valid alterations to change the copyright status. It's comparable to a re-arranged/remixed/covered piece of music whose copyright does not (necessarily) belong to the original song's composer, but to the remixer/re-arranger/cover artist. Apart from that there is nothing wrong with making in-game screenshots from any Age of Empires game. It's not forbidden in any way, except for claiming being the creator of content that has been made by Ensemble Studios/Big Huge Games. A screenshot of Age of Empires 3 (without the mod) is both a derivative work and a copy of the content in the game. It would be infringement unless it is licensed (perhaps impliedly) or otherwise exempt (such as being a fair use). In either case, it is impossible to say that such a screenshot could be freely licensed (which is, incidentally, why most non-free games on Wikipedia have non-free screenshots used under WP:NFCC). Claiming to have been the creator of content is a trademark issue (reverse passing off) and perhaps an ethical issue of plagiarism, but both are separate and distinct from copyright. And your musical example is faulty: re-arranged/remixed/covered songs must be authorized by the original author, and each time a band plays a cover, it pays royalties to the author of the song. • Just some context: the uploader, User:Bnustudent, has had a large number of copyright violations in the past - see User talk:Bnustudent. OTRS was recently made aware of a copyvio on Commons stemming from this user. He passed this image off as his own public domain work on enwiki, and this got transferred to Commons, and this copyvio has been around from 2008 until today. See VRTS ticket # 2011112810033988. It would be sensible to investigate the full extent of his uploads on both enwiki and Commons. • I visited a falconry fair at Chetwynd Park nearby. There, helicopter rides were offered. I went on one, and I got the seat beside the pilot. I took this photo (and others) while I was in the air. I took this image while riding in a helicopter and I am its author. The page http://versacibridal.com/sheathing-wrekin-carp/ that your Google search found, seems to link to http://upload.wikimedia.org/wikipedia/en/0/06/Aa_edgmond_from_heli_20070506.jpg . There is no copyvio! I took a screenshot of the video that you named above, which is my right to do. I even listed the author in my file description of File:Soanya ahmad-2010.jpg as Harold Channer as he owns the rights to the video. I don't see what your problem is here. If you insist on giving the video source of the screenshot, then I can just include that in the description at Flickr.

Also, I noticed that you objected to the photo I submitted of Ellen Barkin (File:Ellen Barkin 2009.jpg). Actually, she personally requested a better photo in that article, and I was trying to help her out. Do I need to get permission from the "More" magazine for that photo? I have seen it being used elsewhere, without proper credit given. At least I listed the source as "More" mag, which is more than most people.
