I am trying to figure out how to respond to you. I apologize for the delay. I'm new to adding things here. So with these comments I hope they make it to you. I appreciate your comments. Uploading a photo is far more tougher than one would think. I do have permission to use the photo, and already sent the e-mail of agreement to Permissions [permissions-at-wikimedia-org]. I am not sure how to place a link with the pic, to the e-mail I received. Thanks for any help you might give.

But was she granted by the photographer the rights to use the photograph for whatever she pleases? Taking an image of an object makes it you own work, and not derivative. As such, I am removing the tag placed on the image page, and subsequent captions. For example, look at articles like Game Boy, where a picture is used under a free license. Asenine ^{(talk)(contribs)} 16:15, 31 January 2008 (UTC)[reply]

If you read the commons policy page about derivative works, you'd find that a Game Boy is a utilitarian object, which is not copyrightable. Commons:COM:DW#If I take a photograph of a kid who is holding a stuffed Winnie the Pooh toy, does Disney own the copyright in the photo since they own the Pooh design?, brings the point that using an image of a stuffed doll to illistrate the copyrighted character the doll represents is a derivative.
