• This was tagged by Kelly (talk · contribs) as a derivative work without copyright information about the included work. This monument is a memorial of the sinking of MS Estonia in 1994, so the monument is obviously recent, but I'm not sure if it meets the threshold of originality.   • As the uploader, I would obviously like to see this image retained here at Wikipedia. I'm far from being an expert on copyright law, but looking at [2], it states that according to Estonian law, "It is permitted to reproduce works of architecture, works of visual art, works of applied art or photographic works which are permanently located in places open to the public, without the authorisation of the author and without payment of remuneration, by any means except for mechanical contact copying, and to communicate such reproductions of works to the public except if the work is the main subject of the reproduction and it is intended to be used for direct commercial purposes." Given that Wikipedia is a non-commercial venture, I'd have thought that we are in perfectly legal territory in using this photograph on the encyclopedia. Any further advice would be welcome, particularly because Kelly (talk · contribs) has also placed similar tags on a number of my other Estonian images, which I would also like to see retained here.     Ethan Doyle White - I do want to thank you for your lovely photos. I have been copying many to Wikimedia Commons and adding their scheduled monument and listed building information; I also added several last night to List of scheduled monuments in West Somerset. In regards to freedom of panorama in Estonia, more information here. Unfortunately, Wikipedia's copyright rules state that content has to be free to re-use for any purpose, commercial or non-commercial. Any exceptions would have to fall under the non-free content criteria, under which it might be possible to keep images of the copyrighted sculptures if they meet the criteria, particularly if they accompany critical commentary of the particular artwork.     I understand your desire to use the images Ethan Doyle White and also think they are quite nice, but I think you need to be very careful and not simply convert every "free" image whose copyright status is being questioned to non-free. The non-free content criteria are quite limiting and purposely make images harder to use. A valid separate, specific non-free use rationale is required for each use, so converting to non-free may actually mean that the image can no longer be used in certain articles or on certain pages, such as your userpage. I suggest you take a look at WP:NFC and make sure this is really what you want to do. -- Marchjuly (talk) 22:23, 20 October 2015 (UTC)[reply]
