• Originally orphaned by me, but that was contested, so I am bringing it here for wider input. Image was used on Zorro to illustrate the similarities between Zorro and the Queen of Swords. Though these similarities are striking, I do not feel they are important enough to warrant the use of this image, especially as the section on the similarities is a single item in a list and unsourced, and as the section is already well illustrated. In short, I do not feel that the image "significantly increases reader understanding of the topic", the topic being Zorro. See the non-free content criteria. • I believe this image is relevent to the text because The Queen of Swords television series was made between the two recent Zorro films (probably to ride on popularity of said films) and illustrates the text which points out the similarities. The text was originally included in the Zorro on Television section until I made a comment on the talk page and another editor moved it to popular culture which is it's correct place. There is only one other image in the popular culture section 'Texas Tech'. It is the largest section within Popular culture and the fact that the official Zorro website[1] has used an edited version of the wikipedia still leaving The Queen of Swords section the largest despite rumours at the time Zorro Inc sued the producers, they seemed to accept QoS is part of Zorro folklore.REVUpminster (talk) 00:04, 20 August 2009 (UTC)[reply]

• As it stands, the paragraph is original research. As long as that's true, the image is patently unjustifiable. If there were to be sources found to verify the claims, it is more arguable that the image is necessary. • Keep. The presumption with images of dead people is that a replacement image doesn't exist, and I really can't see this interfering with commercial opportunities for the image. If someone wants to use a non-free image of Mr. Burns illegally, there are plenty of other outlets from which they could acquire one. Stifle (talk) 08:08, 21 August 2009 (UTC)[reply]

      • Normal circumstances are where a press photo is used to represent an object or person, and there is no sourced commentary about the photograph itself. • Weak delete per WP:NFCC#2. I am loathe to say that images like this are replaceable; the presumption is that a photo of a dead person is not.   • Getty sent a cease and desist to NORML for using the 30-year-old image of pot smoking Obama in a poster [2]. This piece about Getty suing a gossip website that was using pictures of Brad Pitt's + Angelina Jolie's baby without permission is almost directly on point [3]. IANAL, but I cannot fathom how our use is anything but copyright infringement. It may be that Getty will never send a c&d to us just because they don't want the bad publicity or because you can't get blood from a turnip, but any time we use a news media photo where the photo itself is not the subject of discussion (as opposed to being used to illustrate a discussion about the thing depicted in the photo), that's blatant infringement. If our NFCC don't make that clear, the problem is with our NFCC. Just because they were there and we weren't doesn't give us the right to steal their photo - if we want it, we have to pay royalties. --B (talk) 12:03, 20 August 2009 (UTC)[reply]

The all too common claim of "depicting a specific event in history" (other variations include "depicting a specific point in his/her career" and "depicting a point of view that is not recreatable") is simply nonsense. We have absolutely no business using Getty photos like this. I appreciate that her wearing the dress is discussed in the article, but WP:NFCC#1 suggests that image is not required as the textual description is sufficient.
