• I have sent an email to the webmaster of the site this image came from asking if there is a copyright notice in the yearbook. • I have received a reply from the webmaster of this site and he is not in physical possession of the original yearbook. So we have no way of knowing whether there was a copyright notice and have to presume (until proven otherwise) that there was. • Comment it clearly illustrates the school grounds and building and configuration, so isn't "purely" decorative. The layout and buildings of a school is a basic part of the information of such an institution.   Exactly. A free modern replacement can be produced, so in order for a historic photo like this to be valid fair use, it must demonstrate a feature of the school which a modern photo cannot.
