Cmapm (who is now inactive) received a sort of permission from the webmaster of the site which hosted this photo. That message said: "I don't see any obstacles in your use of materials from the website www.gymnast.ru for the Internet-encyclopedia" (emphasis added). Cmapm tried to explain the difference between the GFDL and permission for use on Wikipedia (a variant of fair use). In response he got a reply from the webmaster's granddaughter that "she didn't understand the essence of the problem and gives me a right to decide, believing in my honesty (that I'll not harm in any way neither the website, nor E.V.Avsenev)." Cmapm, playing it safe, stuck with the old permission template (fair use).
Since then, King of Hearts tagged the image as released under the GFDL, citing the note from the granddaughter quoted above. I don't know what the standard is here. Traditionally on Commons we require something from the copyright holder. Accepting the fudge of having the granddaughter communicate with someone from Wikipedia, we still have someone that does not understand what rights they are giving away delegating to us the decision to give anyone the right to use this photo to turn a profit. Would she have done that if she'd understood? Would her grandfather? I have no idea.
An entirely separate issue that I just noticed is that there is no evidence the webmaster for http://www.gymnast.ru/ actually owns the image in question. The only clue is that he is/was a "master of sports...and journalist, for many years dealing with history and statistics in the field of gymnastics." Did he grab this simple portrait from some other site on the internet? I have no idea.
Andrianov died yesterday, making the case better for a fair use portrait (although there is already one picture of him in the article). However, I do not think we have good enough evidence to freely license this image. Given the desirability of an image of him on the main page and the requirement that any such image be truly free, it would be helpful to resolve this issue quickly.Chaser (talk) 22:43, 22 March 2011 (UTC)[reply]
