The picture was taken by a family member in Walter Balderson's living room for the latter's own blog http://www.walterbalderson.com/, as such he's the owner/copyright holder. The photographer is not necessarily the copyright holder, you know. He emailed permission to me which I forwarded to OTRS when I was creating the article about him. Walter Balderson is my uncle and lives 5 minutes away from me, so if you insist I'll simply take another picture with my camera.  JGHowes  ^talk 20:33, 26 November 2015 (UTC)[reply]

• Keep Kelly, you may be asking if the image is from a recording or broadcast because of its poor quality. I agree that it's a terrible quality image, but if OTRS has established the authorship and release, then it should be kept. I'm the OTRS agent in question. The issue is indeed that the person depicted is the putative licensor - it is unnervingly common for people to think that "owning" a copy of a photo of themselves somehow makes them the copyright holder. Unfortunately, the original OTRS agent did not ask for clarification regarding how the copyright was transferred to the person depicted. I'm not sure that was standard practice in 2008, but it is now. Somewhat tangentially, these days we would also usually ask for a direct email from the copyright holder, rather than relying on a forwarded one. • There are any number of Old West photographs for whom the original photographer and source is unknown, and the date or original publication likely precedes the person's death prior to 1923, e.g., Jesse James, Luke Short, Virgil Earp, Billy Claiborne, Edward Schieffelin, Johnny Behan, and others. As to the date of first publication, Wells Spicer died in 1885, so it's safe to assume that it was published well before 1923.
