However, no evidence has been presented that the copyright also was transferred to the archive or that the photo has been released to the public domain.   • What is your source for that claim? This page tells that the photo was moved from place to place several times, sometimes without transferring copyright (see e.g. the statement about an agreement expiring in 1986). From that page, it is not clear if the copyright holder had access to the negative when the negative was donated to the archive, or if the owner of the physical negative was the same as the copyright holder. Furthermore, nothing is told about what happened with the copyright after the transfer of the negative. According to City of Tampa Ordinance 2000-227, Sec. 4-6, the city has title and ownership of all public art commissioned by the city or any of its agencies, such as this statue. Florida's public records law "overrides a governmental agency's ability to claim a copyright in its work unless the legislature has expressly authorized a public records exemption." This image is in the public domain.

We don't take the deletion notices of ongoing discussions off of a page: period. Cf. ((Uw-afd1)). Only the user who closes the discussion (usually a qualified admin) does that. And I notice you haven't responded to Stefan's query on Commons about the authorship, which is not a small issue at all, as there is a big difference between works for hire (i.e., produced by someone working directly for the state) and works by a contractor. Your argument in invalid. If you read the more verbose Commons version of the ((PD-FLGov)) template, you'll see that the relevant court decision clearly states that the work of "any public body, officer, or employee of the state, or persons acting on their behalf" is in the public domain. The court went on to explain that this applies to "the legislative, executive, and judicial branches of government and each agency or department created thereunder; counties, municipalities, and districts."
