  • Delete: Source given by user that uploaded the image is: [[2]] (and it's Elsie). As I see similar images from the same period were also speedy deleted for similar reason ([[3]]). Since this is from 1946, copywirght has not expired (less than 70 years). It's not PD, and speedy deletion is justified.Alexikoua (talk) 21:28, 1 April 2011 (UTC)[reply]
Alexikoua and when BW added Albanian law he definitely meant this law [4]. Elsie used a picture that belongs to the Albanian state i.e it's PD. The 70+ applies to private works, not material that belongs to the state itself.--— ZjarriRrethues — talk 21:52, 1 April 2011 (UTC)[reply]
Zjarri: Balkanian misused Albanian law (no wonder several similar images that he uploaded were speedy deleted). Also we have already made clear in past that this is not PD under the Albania Law: it needs the usual 70+ years to become PD, as already clarified [[5]]). Please read [[6]]. Alexikoua: Elsie doesn't have the copyright of a 1946 photo that belongs to the Albanian state. FutureP: I can ask Elsie to send an e-mail to wikipedia if that's necessary for the photo to not get deleted, but it belongs to the Directorate of Archives. To put it in more simple terms you can visit the Directorate in Tiranë and ask for access to all public archives and as soon as you get the access you can use any of their documents(even if it is a document of 2010) for any non-commercial use.--— ZjarriRrethues — talk 09:42, 2 April 2011 (UTC)[reply]

What has Elsie got to do with anything? Elsie isn't the copyright holder, so he can't do anything to release this thing either. What we need is a statement from the archive, or relevant info from its catalogs, telling us what the copyright status is. It may be PD or it may not be. You seem to be under the mistaken assumption that everything that's held by a state archive is automatically state property in terms of copyright, and then, that this magically means it's public domain.
