Here are two images of USC quarterback Jeff Grantz wearing the helmet with the "Block C" logo[1][2]. Note on the South Carolina Athletic Hall of Fame page that he played for the Gamecocks from 1973-75. This should put the subject to rest. GarnetAndBlack (talk) 06:16, 3 December 2013 (UTC)[reply]
Incorrect. You actually have to search the U.S. copyright database to see if the logo was registered or not. That there are images with the logo on it without a copyright notice attached is not the same as it never being registered. The logo is trademarked, not copyrighted, as noted in the license tags on the page. This can be easily verified by viewing the logo at the University's website[3]. As this discussion is ongoing, I will be reverting the page with the image file, and restoring the logo to all articles. There is no way to search the US Copyright database prior to 1978 online. Restored to non-free licensing - This was originally a non-free image, and the license was changed by GarnetAndBlack. As I explained above, the foundation for that user's changing the license is based off of a rather serious misinterpretation of the law, so I have changed it back to being non-free. Fairly obvious case of non-free logo, No evidence has been provided that a copyright was never registered. Especially with logos the copyright is normally registered prior to publication. Until it can be proven that a copyright was never filed this must be treated as non-free. Something can be both copyrighted and trademarked at the same time. So you'd like proof of a negative? Also, if a logo is copyrighted and trademarked, then both marks are used. The fact that only the TM mark is used on the USC "Block C" logo on the university's webpage which deals with licensing issues[4][5], is indicative of its non-copyrighted status. Nope. The logo was in use prior to 1983, and was created by the head football coach at USC at the time (1975), Paul Dietzel. This Brierley person can't copyright a work that he didn't create, but it appears he copyrighted a particular use of some logo in the form of a "bumper sticker". For all we know, Brierley copyrighted a saying on the sticker that he combined with the public-domain logo, or he created his own "C symbol", several others have been produced over the years. Absent an actual image of what was being copyrighted in the two links provided, this is proof of nothing. Furthermore, if Brierley had indeed created what is now the official athletic logo for the University of South Carolina, it probably would have been mentioned in the posthumous tribute and/or obituary posted on the school's website[6][7]. As a side note, if the source you provided is to be believed, the gamecock itself appeared at least as early as 1966, and that would likely be copyrighted itself. You keep making statements like this, while offering proof of nothing. I've provided the only evidence in this discussion thus far. Everyone else is offering nothing but speculation and hypotheticals. Produce a single piece of evidence that this logo was ever copyrighted, or admit that this is most likely not the case, as copyright protection of logos in the United States is rare as compared to trademarking. I spoke with someone from the University's trademark office, and it is in fact not copywritten. They were rather cagey about admitting it, and they still claim "all rights title and interest in and to the Gamecock and Block C logo", but it would appear that GarnetAndBlack is correct. I think that it is exceedingly strange that the university did not copyright their logo, but both copyright and the financial/media landscape around collegic sports were very different in 1975. Where do those numbers come from? This file is currently tagged with a copyright tag which only can be used for photographs, but this is obviously not a photograph. Keep Under Lebanese law, it doesn't matter who the photographer was and when he or she died. As the template says "It is a photographic or cinematographic work and fifty years have elapsed since the end of the year of production.". Considering, as Stefan2 says, that the person depicted died in 1914, this is over 50 years old, and PD-Lebanon applies. Keep - Images enter into the public domain in Malta 70 years after their creation if the author cannot be identified. John Howard died on 20 May 1925, more than 70 years ago, and there is no authorship identification that I can track down for the image, including on the Maltese government's website, which also has this image. As has been shown, this is an RNZAF Official photograph. As such it is under the copyright of a Crown entity, not an individual, and it has been used in several published works as an RNZAF Official photograph. As it is it is being used in Wikipedia for non-profit educational purposes, in line with the NZ Copyright Act 1994.
Accordingly, the correct template
This image from New Zealand is in the public domain both in New Zealand and in other countries adhering to international copyright treaties, because New Zealand Crown copyright has a 50-year term under Section 26(3)(b) of the Copyright Act 1994 if the image was produced before 1945.
